A Contractor’s License Can Be Disciplined if the Citation is Not Answered

What is a Citation from the Registrar of Contractors?

A citation is a legal document issued by the Registrar to a licensed contractor. The citation requires the contractor to respond to allegations that the contractor has violated statutes.

What happens if the contractor ignores the citation?

If the Registrar issues a citation, the contractor needs to handle it, because failing to respond to a ctiation has bad consequences.

Specifically, failing to respond to the citation in the proper time means two things:

  1. Admission by Contractor: The contractor admits the allegations in the complaint and the citation
  2. Discipline against License: The Registrar can discipline the contractor’s license

The Relevant Statute: A.R.S. § 32-1155

Section C of A.R.S. § 32-1155 states what the Registrar can do if the licensed contractor fails to respond to a citation within the proper time. Here’s the statute:

C. Failure of the licensee to answer within ten days after service may be deemed an admission by the licensee of the licensee’s commission of the act or acts charged in the complaint, and the registrar may then suspend or revoke the licensee’s license unless the registrar determines, in its sole discretion, that the failure to answer within such period is attributable to excusable neglect on the part of the licensee.
